These Terms and Conditions (“Terms”) are applicable to the Intel® Skills For Innovation Program (“Program”) and all Course Content, including but not limited to the online Hosting Platform (“Website”) and any Website Content, Activities, and/or Dashboards including but not limited to webinars, contests, articles, discussions, and community-generated content, including that which may be available now and/or from time to time, and/or in the future. Certain Program Activities or resources may contain specific terms in addition to these Terms. In the event of a conflict between such specific terms and these Terms, the specific terms of such Program Activities or resources shall control.
By participating in the Program, each Educational Institution and each Member affirms that they have read and accept these Terms and meet all Program Eligibility criteria set forth herein.
The Intel® Skills for Innovation is designed for K-12 (or equivalent) schools. Additional eligibility requirements include:
- Signing the Intel® SFI content license agreement
Educational Institutions that meet the above requirements (each an “Approved Educational Institution”) are eligible to participate in the Program.
To qualify as a member of the Program (a “Member”) and be eligible for participation in the Program, individuals must meet the following eligibility requirements (unless otherwise granted eligibility by Intel):
Final determination of eligibility and Program tier assignment of Approved Educational Institutions is at the sole discretion of Intel Corporation (“Intel”).
Members must be employed at the time of all aspects of participation in the Program (or parts thereof) at an Approved Educational Institution. Members at an Approved Educational Institution that has been deactivated in the Program are not eligible.
An Approved Educational Institution may be disqualified and removed from the Program if they become incompatible with the Program as determined by the Intel, or the Approved Educational Institution may be reassigned to a different Program in Intel’s sole discretion.
Once a determination of disqualification or Program reassignment has been made, Members employed with that Institution will be sent an e-mail, providing a 90-day notice of deactivation or reassignment of the Institution and all Member Accounts (defined below) registered to the Program under that organization. Additionally, Members with current employment verification will have their verification renewed for an additional 90 days. During this 90-day period, Members may continue to participate in all aspects of the Program for which they are eligible.
If a Member has obtained employment at another eligible organization, they will need to update their Account with the correct information within the 90-day period to keep their Account active.
In order to participate in the Program, each Member must register and establish a Program Account (“Account”). Members are limited to one (1) active Account per person. To register each Member must:
Note: Member name changes will only be allowed at Intel’s sole discretion, on a case by case basis.
Members will need to enter a password during the registration processes. Members are solely responsible for maintaining the confidentiality of the password and username. Members are responsible for any and all activities incurred to their Account. Members must notify Intel, through online help desk, immediately of any suspected unauthorized use or other breach of security to their Account.
Intel will not be liable for any loss incurred as a result of an unauthorized use. However, Member could be held liable for losses incurred by Intel or another party due to an unauthorized use of Member’s Account.
If a Member wishes to close their account or remove content they have submitted, they will need to request this by contacting Help Desk Support. Once an Account is deactivated, Members will not be able to participate in any aspect of the Program. A deactivated account may be reinstated upon request on a case-by-case basis at Intel’s sole discretion.
Intel may terminate a Member’s Account at its absolute discretion and for any reason. Activities that may result in a Member’s termination from the Program include but are not limited to:
Intel’s termination of Member’s Account access may be effected without notice and, on such termination Intel may immediately deactivate or delete Member’s Account and/or bar any further access. Intel shall not be liable to any Member or other third-party for any Account or access termination. These Terms will remain in full force and effect notwithstanding any Account termination.
Member conduct should be guided by common sense, professional behavior, and basic etiquette, as well as these Terms and any other Program Activity-specific terms. Members must also obey state, local, federal, and international laws where applicable.
Impersonating other users or Members or sending false verification information is considered fraudulent activity and will result in the termination of Member’s Account, and may result in a Member being permanently banned from the Program. Intel reserves the right to prosecute any individual engaging in fraudulent or illegal activity.
Members are personally responsible for their communication and activity in the Program, including any content contributed, whether via uploading contents, chat, e-mail, or the Message Boards (as defined below). Intel will monitor comments posted to the Website and reserves the right to remove any comments at its sole discretion.
Any Member information collected by the Program shall be used only in a manner consistent with the consent given by participants at the time of the entry, with these Terms, and with the Intel Online Privacy Notice at:

Intel will not share Member information with other individuals or companies without the Member’s permission except that Intel may share Member’s personal information internally or with its authorized agencies as necessary (in the opinion of Intel), for the administration of the Program or to provide Program-related communications.
Participation in the Program may include additional activities organized by Intel or Intel in combination with partners, including but not limited to teacher competitions, webinars, surveys, and other activities. Such activities may include technology solutions promotions by the Intel or its partners.
Intel is committed to respecting your privacy. By choosing to participate in this program, you may provide Intel the personal information included in the registration form. Your personal information will be used for internal purposes and you may receive further communications if you select the option. We will keep your information for up to two years to communicate with or provide services to you or as otherwise required by law. Intel is committed to respecting your privacy. By completing the registration process, you are providing Intel your business contact information, job position, and personal information. This information will be used for the purpose of facilitating the registration process, creating a welcoming experience, and for data analysis purposes. Intel will use the Personal Information in accordance with applicable data protection laws and regulations, and Intel’s privacy notice, www.intel.com/privacy .
If a Member has not successfully completed an Activity (completed learning, viewed article, accessed resource, uploaded resource) in the previous 180 days, they are considered inactive. The Member’s Account will remain inactive until the Member completes a Learning Activity.
After two years (730 days), inactive accounts may be purged.
Intel may terminate the Program with 90-days’ notice on the Program Website. Intel may, at its sole discretion, amend or change these Terms including the Program conditions of membership.
The Website may host or facilitate Activities or services for the purpose of allowing Members to share content, ideas and materials publicly (the “Member Content”). Use of these services and activities is limited to eligible Members and is governed by these Terms and any other Program Activity specific terms provided.
Intel does not claim ownership of any Member Content submitted, posted, transmitted, made available or displayed on, or through, the Website, including, but not limited to, data, text, sounds, images, videos, diagrams, audio, information, graphs, or descriptions on the Website. Unless otherwise agreed to in writing, there is no compensation for Member Content. Intel is under no obligation to post or use any Member Content submitted and Intel may remove any Member Content at any time in its sole discretion.
By posting, uploading, inputting, providing or otherwise submitting Member Content, Member grants Intel, its affiliated companies, sublicensees and Website users, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable and sublicensable license, to reproduce, modify, create derivative works, publicly display, publicly perform, disclose, distribute, license and sublicense, incorporate and otherwise use the Member Content and all data, images, sounds, text, and other things embodies therein (in whole or in part) and to incorporate such Member Content into other works in any format or medium now known or later developed for any and all commercial or non-commercial purposes.
All Member Content, whether publicly posted or privately transmitted, is the sole responsibility of the Member from whom such content originated. This means that Member, and not Intel, is entirely responsible for any and all content that Member uploads, posts, shares, or otherwise displays via the Program or Website. Member is prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, or other material that would violate any law.
By posting or submitting Member Content, Member represents and warrants that Member owns or otherwise controls any and all of the rights to Member Content including, but not limited to, all the rights necessary for Member to provide, post, upload, input or submit the Member Content. To the extent that the Member Content submitted contains copyrighted content Member represents and warrants that:
(a) Member is the copyright owner of such content, or that the copyright owner has granted Member permission to use such content consistent with the manner and purpose of Member use;
(b) Member has the rights necessary to grant the licenses and sublicenses described in these Terms; and
(c) that each person depicted in such content, if any, has provided consent to the use of the content. Intel reserves the right to request a proof of ownership or permission, and to refuse to post Member Content without such proof or if such proof is not, at its sole discretion, sufficient.
Member acknowledges that Intel may or may not moderate or pre-screen Member Content submitted. Intel and its designees retain the right, at Intel’s sole discretion to pre-screen, refuse, monitor, restrict access to, edit, or remove any Member Content from the Website. Without limiting the foregoing, Intel reserves the right (but not the obligation) to refuse or delete any Member Content of which it becomes aware and at its sole discretion deems infringing or otherwise illegal, inappropriate, non-compliant with these Terms, or not to fulfill the spirit or purpose of the Website. Intel, in its sole and absolute discretion, may preserve Member Content and may also disclose Member Content if required to do so by law or judicial or governmental mandate or as reasonably determined useful by Intel to protect the rights, property, or personal safety of the Website, its users and the public.
Intel does not control the Member Content posted to the Website and, as such, does not guarantee the accuracy, integrity or quality of such Member Content. Under no circumstances will Intel be liable in any way for any Member Content, including, but not limited to, liability for any errors or omissions in any Member Content or for any loss or damage of any kind incurred as a result of the use of any Member Content posted, e-mailed or otherwise transmitted via the Website.
By submitting content, Member agrees their disclosure is gratuitous, unsolicited and without restriction and will not place Intel under any fiduciary or other obligation, that Intel is free to disclose the ideas in the Member Content on a non-confidential basis to anyone or otherwise use the ideas without any additional compensation. Member acknowledges that, by acceptance of Member submission, Intel does not waive any rights to use similar or related ideas previously known to Intel, or developed by its employees, or obtained from sources other than Member.
Each Member hereby indemnifies and agrees to hold harmless Intel and its affiliates and their respective agencies, fulfillment companies, vendors, contractors, participating resellers and advertising and promotional agencies and agents, and all of their respective officers, directors, shareholders, employees and agents (collectively, “Indemnitees”) harmless from and against any and all loss, expense, liability, damage, claim (including reasonable attorneys’ fees) (collectively, “Claims”) including but not limited to those Claims for personal injury including death or injury to property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of merchandise or prizes, participation in any Program Activity, or participation or inability to participate in this Program or any part thereof.
Each Member further agrees to indemnify and hold harmless Indemnitees from and against any and all Claims made by any third-party due to or arising out of any and all content Member submits, posts, transmits or otherwise makes available through the Website, Member’s use of the Website and other conduct throughout the Program, Member’s connection to the Website and Program, Member’s violation of these Terms, or Member’s violation of any rights of another.
MEMBER PARTICIPATION IN THE PROGRAM, PROGRAM ACTIVITIES AND USE OF THE WEBSITE IS AT MEMBER’S SOLE RISK. ALL ASPECTS OF THE PROGRAM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ANY AND ALL WARRANTIES FOR PROGRAM MERCHANDISE, PRIZES, OR PARTS THEREOF ARE PROVIDED ONLY BY THE MANUFACTURER’S WARRANTY FOR SUCH PRODUCTS, IF ANY. EXCEPT AS EXPRESSLY PROVIDED OTHERWISE IN THESE TERMS, INTEL MAKES NO REPRESENTATION OR WARRANTY THAT (1) THE PROGRAM OR ANY SERVICES THEREON WILL MEET MEMBER’S REQUIREMENTS, (2) MEMBER ACCESS WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, (3) THE QUALITY OF ANY CONTENT, PRODUCTS, SERVICES, ACTIVITIES, EVENTS, INFORMATION OR OTHER MATERIAL OBTAINED BY ANY MEMBER WILL MEET HIS OR HER EXPECTATIONS, (4) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED, AND (5) ANY CONTENT UPLOAD TO THE WEBSITE IS PROTECTED OR SECURE, AND INTEL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND REGARDING, RELATING TO OR OTHERWISE ARISING FROM THE PROGRAM INCLUDING BUT NOT LIMITED TO: (i) TERMINATION FROM THE PROGRAM, (ii) DELETION, UNAUTHORIZED ACCESS TO OR ALTERATION OF A MEMBER’S ACCOUNT, (iii) MEMBER CONTENT, (iv) USE OF THE WEBSITE, (v) CONTENT ON THE WEBSTIE INCLUDING STATEMENTS OR CONDUCT OF ANY THIRD-PARTY ON THE WEBSITE, (vi) DISQUALIFICATION FROM A PROGRAM ACTIVITY OR EVENT, (vii) WHETHER SUCH WARRANTIES ARE WRITTEN, ORAL, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ARISING FROM COURSE OF DEALING OR USAGE IN TRADE.
IN NO EVENT SHALL INTEL, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS BE LIABLE TO ANY MEMBER, OR ANYONE CLAIMING THROUGH A MEMBER, FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA, INTERRUPTION OF BUSINESS, AND COST OF PROCUREMENT OF SUBSTITUTES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE (EVEN IF INTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING IN ANY WAY TO THE PROGRAM INCLUDING BUT NOT LIMITED TO ALL PROGRAM ELEMENTS LISTED ABOVE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO MEMBER.
Intel may establish general practices and limits concerning use of the Website. While Intel will use reasonable efforts to back up site data and make such data available in the event of loss or deletion, Intel has no responsibility or liability for the deletion or failure to store any data or other content maintained or transmitted by others on the Website or any other Intel site. Intel reserves the right to purge Accounts and/or Member Content that is inactive for an extended period of time. Intel reserves the right to change these general practices at any time, at its sole discretion.
Intel logos and service marks, and product and service names are Intel trademarks or registered trademarks in the United States and in other countries (the “Intel Corporation Marks”). These Terms do not grant Member any license in Intel trademarks or any Intel owned assets or intellectual property. All other names and designs may be trademarks of their respective owners.
Intel respects the intellectual property rights of others, and requires that the people who use the Website do the same. It is Intel’s policy to respond promptly to claims of intellectual property misuse. If Member believes that their work has been copied and is accessible on the Website in a way that constitutes copyright infringement, Member may notify Intel at DMCA Process found here: http://www.intel.com/content/www/us/en/legal/dmca-notice-and-procedure.html
If Intel determines, based on its sole discretion that Member is a repeat offender under the DMCA, the Member Account may be deactivated, all Member Content removed, and Intel reserves the right to take any other actions it deems necessary, including canceling the Member’s membership in the Program and notifying the appropriate government authorities. Intel is not responsible for third-party content shared on the Program Website.
These Terms and information on the Website that is hyperlinked to these Terms constitute the entire agreement between Member and Intel regarding the Program and govern Member use of the Website. Each Member may be subject to additional terms and conditions that may apply when that Member participates in Program Activities or uses affiliate services, third-party content or software. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. The section titles in these Terms are for convenience only and have no legal or contractual effect. The provisions of these Terms that would be reasonably expected to survive termination of any Account shall do so, including without limitation, the following sections: Member Accounts, Privacy and Personal Information, Member Content / Message Boards, Indemnification and Hold Harmless, Warranty Disclaimer, Limitation of Liability, and General Terms, which shall remain in full force and effect notwithstanding any termination of an Account or a Member’s other use of or participation in the Program.
The Terms and the relationship between Member and Intel shall be governed by the laws of the State of Delaware without regard to its conflict of law provisions and each party shall submit to the personal and exclusive jurisdiction of the courts located within the State.
In the case of any violation of these Terms, Intel reserves the right to seek all remedies available under these Terms and at law and in equity for such violations. Please report any violations of the Terms (except for claims of copyright infringement, see paragraph 3 above for instructions) to the Program by contacting Program Support.
Intel may revise these Terms at any time by updating this posting. Members should visit this page from time to time to review the then-current Terms because they are binding on Members. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on Website, particular activities, or materials.

Deze Voorwaarden ("Voorwaarden") zijn van toepassing op het Intel® Skills For Innovation Programma ("Programma") en alle Cursusinhoud, inclusief maar niet beperkt tot het online Hosting Platform ("Website") en alle Website-inhoud, Activiteiten en/of Dashboards, inclusief maar niet beperkt tot webinars, wedstrijden, artikelen, discussies en door de gemeenschap gegenereerde inhoud, inclusief de inhoud die nu en/of van tijd tot tijd en/of in de toekomst beschikbaar kan zijn. Bepaalde programma-activiteiten of bronnen kunnen specifieke voorwaarden bevatten in aanvulling op deze Voorwaarden. In het geval van een conflict tussen dergelijke specifieke voorwaarden en deze Voorwaarden, prevaleren de specifieke voorwaarden van dergelijke programma-activiteiten of bronnen.
Door deel te nemen aan het Programma, bevestigt elke Onderwijsinstelling en elk Lid dat zij deze Voorwaarden hebben gelezen en aanvaard en voldoen aan alle criteria om in aanmerking te komen voor het Programma zoals hierin uiteengezet.
De Intel® Skills for Innovation is bedoeld voor K-12 (of gelijkwaardige) scholen. Aanvullende voorwaarden om in aanmerking te komen zijn:
- Ondertekening van de Intel® SFI inhoudslicentieovereenkomst
Onderwijsinstellingen die aan bovenstaande eisen voldoen (elk een "Erkende Onderwijsinstelling") komen in aanmerking voor deelname aan het programma.
Om in aanmerking te komen als lid van het Programma (een "Lid") en om in aanmerking te komen voor deelname aan het Programma, moeten personen voldoen aan de volgende vereisten om in aanmerking te komen (tenzij Intel anderszins toestemming geeft om in aanmerking te komen):
Intel Corporation ("Intel") bepaalt uiteindelijk welke onderwijsinstellingen in aanmerking komen en welke niveaus van het programma worden toegekend.
Leden moeten ten tijde van alle aspecten van deelname aan het Programma (of delen daarvan) werkzaam zijn bij een Erkende Onderwijsinstelling. Leden bij een Erkende Onderwijsinstelling die is uitgeschakeld in het Programma komen niet in aanmerking.
Een Erkende Onderwijsinstelling kan worden gediskwalificeerd en verwijderd uit het Programma als zij onverenigbaar wordt met het Programma zoals bepaald door Intel, of de Erkende Onderwijsinstelling kan naar eigen goeddunken worden overgeplaatst naar een ander Programma.
Zodra is vastgesteld dat de instelling is gediskwalificeerd of het programma opnieuw is toegewezen, ontvangen de leden die bij die instelling werken een e-mail met een kennisgeving van 90 dagen van de deactivering of overdracht van de instelling en alle ledenrekeningen (hieronder gedefinieerd) die bij die organisatie voor het programma zijn geregistreerd. Bovendien wordt voor Leden met een huidige arbeidsverificatie de verificatie met 90 dagen verlengd. Gedurende deze periode van 90 dagen kunnen de Leden blijven deelnemen aan alle aspecten van het Programma waarvoor zij in aanmerking komen.
Indien een Lid een baan heeft gekregen bij een andere in aanmerking komende organisatie, moet hij zijn Account binnen de periode van 90 dagen met de juiste informatie bijwerken om zijn Account actief te houden.
Om deel te nemen aan het Programma moet elk Lid zich registreren en een Programma-account ("Account") aanmaken. Leden zijn beperkt tot één (1) actieve Account per persoon. Om zich te registreren moet elk Lid:
Opmerking: Naamsveranderingen van leden worden alleen toegestaan naar goeddunken van Intel, per geval.
Leden moeten tijdens het registratieproces een wachtwoord invoeren. Leden zijn zelf verantwoordelijk voor het geheimhouden van het wachtwoord en de gebruikersnaam. Leden zijn verantwoordelijk voor alle activiteiten op hun account. Leden dienen Intel, via de online helpdesk, onmiddellijk op de hoogte te stellen van enig vermoedelijk onbevoegd gebruik of andere inbreuk op de beveiliging van hun Account.
Intel is niet aansprakelijk voor enig verlies als gevolg van onbevoegd gebruik. Het Lid kan echter wel aansprakelijk worden gesteld voor verliezen die Intel of een andere partij lijdt als gevolg van onbevoegd gebruik van het Account van het Lid.
Als een Lid zijn account wil sluiten of inhoud die hij heeft ingediend wil verwijderen, moet hij dit aanvragen door contact op te nemen met Help Desk Support. Zodra een account is gedeactiveerd, kunnen Leden niet meer deelnemen aan enig aspect van het Programma. Een gedeactiveerde account kan op verzoek worden hersteld op individuele basis en naar eigen goeddunken van Intel.
Intel kan het Account van een Lid naar eigen goeddunken en om welke reden dan ook beëindigen. Activiteiten die kunnen leiden tot beëindiging van het Programma door een Lid zijn onder meer:
Intel kan de toegang tot het Account van het Lid zonder voorafgaande kennisgeving beëindigen en bij een dergelijke beëindiging kan Intel het Account van het Lid onmiddellijk deactiveren of verwijderen en/of verdere toegang blokkeren. Intel is niet aansprakelijk jegens een Lid of een andere derde partij voor beëindiging van het Account of toegang. Deze Voorwaarden blijven volledig van kracht ondanks beëindiging van het Account.
Leden moeten zich laten leiden door gezond verstand, professioneel gedrag en elementaire etiquette, evenals deze Voorwaarden en alle andere programma-activiteiten-specifieke voorwaarden. Leden moeten zich ook houden aan staats-, lokale, federale en internationale wetten waar van toepassing.
Het zich voordoen als andere gebruikers of Leden of het verzenden van valse verificatiegegevens wordt beschouwd als frauduleuze activiteit en zal leiden tot beëindiging van het Account van het Lid en kan ertoe leiden dat een Lid permanent wordt uitgesloten van het Programma. Intel behoudt zich het recht voor om personen die zich bezighouden met frauduleuze of illegale activiteiten te vervolgen.
Leden zijn persoonlijk verantwoordelijk voor hun communicatie en activiteiten in het programma, inclusief alle bijgedragen inhoud, hetzij via het uploaden van inhoud, chat, e-mail of de prikborden (zoals hieronder gedefinieerd). Intel houdt toezicht op de opmerkingen die op de Website worden geplaatst en behoudt zich het recht voor om opmerkingen naar eigen goeddunken te verwijderen.
Alle door het programma verzamelde informatie van de deelnemers zal
uitsluitend worden gebruikt op een wijze die in overeenstemming is met de
toestemming die de deelnemers hebben gegeven op het moment van
deelname, met deze Voorwaarden en met de online privacyverklaring van
Intel op het volgende adres

Intel zal geen informatie van leden delen met andere personen of bedrijven zonder toestemming van het lid, behalve dat Intel de persoonlijke informatie van leden intern of met bevoegde instanties kan delen indien dit noodzakelijk is (naar de mening van Intel) voor het beheer van het programma of om programma-gerelateerde mededelingen te doen.
Deelname aan het Programma kan extra activiteiten omvatten die worden georganiseerd door Intel of Intel in combinatie met partners, inclusief maar niet beperkt tot wedstrijden voor docenten, webinars, enquêtes en andere activiteiten. Dergelijke activiteiten kunnen ook betrekking hebben op promotie van technologieoplossingen door Intel of haar partners.

Intel respecteert uw privacy. Door het registratieproces te voltooien, verstrekt u Intel uw zakelijke contactgegevens, functie en persoonlijke informatie. Deze informatie wordt gebruikt om het registratieproces te vergemakkelijken, een gastvrije ervaring te creëren en voor gegevensanalyse. Intel zal de persoonlijke informatie gebruiken overeenkomstig de toepasselijke wet- en regelgeving inzake gegevensbescherming en de privacyverklaring van Intel, www.intel.com/privacy .
Als een lid in de afgelopen 180 dagen geen activiteit met succes heeft voltooid (learning voltooid, artikel bekeken, bron geraadpleegd, bron geüpload), wordt hij/zij als inactief beschouwd. Het account van het lid blijft inactief totdat het lid een leeractiviteit heeft voltooid.
Na twee jaar (730 dagen) kunnen inactieve accounts worden verwijderd.
Intel kan het Programma beëindigen met een opzegtermijn van 90 dagen op de Programmawebsite. Intel kan, naar eigen goeddunken, deze Voorwaarden wijzigen of aanpassen, inclusief de programmavoorwaarden.
De Website kan Activiteiten of diensten hosten of faciliteren met als doel Leden toe te staan inhoud, ideeën en materialen publiekelijk te delen (de "Ledeninhoud"). Het gebruik van deze diensten en activiteiten is beperkt tot in aanmerking komende Leden en wordt beheerst door deze Voorwaarden en eventuele andere specifieke voorwaarden voor Programma-activiteiten.
Intel claimt geen eigendom van Ledeninhoud die wordt ingediend, geplaatst, verzonden, beschikbaar gemaakt of weergegeven op of via de Website, inclusief maar niet beperkt tot gegevens, tekst, geluiden, afbeeldingen, video's, diagrammen, audio, informatie, grafieken of beschrijvingen op de Website. Tenzij schriftelijk anders is overeengekomen, is er geen vergoeding voor Ledeninhoud. Intel is niet verplicht om ingediende Ledeninhoud te plaatsen of te gebruiken en Intel kan Ledeninhoud te allen tijde naar eigen goeddunken verwijderen.
Door het plaatsen, uploaden, invoeren, verstrekken of anderszins indienen van Ledeninhoud, verleent de Lid een wereldwijde, niet-exclusieve, eeuwigdurende, onherroepelijke, royaltyvrije, overdraagbare en sublicentieerbare licentie aan Intel, haar gelieerde ondernemingen, sublicentiehouders en Websitegebruikers, om de Ledeninhoud te reproduceren, te wijzigen, afgeleide werken te creëren, publiekelijk weer te geven, publiekelijk uit te voeren, de Ledeninhoud en alle gegevens, beelden, geluiden, tekst en andere zaken die daarin zijn vervat (geheel of gedeeltelijk) te reproduceren, te wijzigen, afgeleide werken te maken, openbaar te maken, te verspreiden, in licentie te geven en in sublicentie te geven, op te nemen en anderszins te gebruiken en dergelijke Ledeninhoud op te nemen in andere werken in elk nu bekend of later ontwikkeld formaat of medium voor alle commerciële of niet-commerciële doeleinden.
Alle Inhoud van Leden, of deze nu openbaar is geplaatst of privé is verzonden, is uitsluitend de verantwoordelijkheid van het Lid van wie deze inhoud afkomstig is. Dit betekent dat het Lid, en niet Intel, volledig verantwoordelijk is voor alle inhoud die het Lid uploadt, plaatst, deelt of anderszins weergeeft via het Programma of de Website. Het Lid mag geen onwettige, bedreigende, lasterlijke, obscene of andere materialen plaatsen of verzenden die in strijd zijn met de wet.
Door het plaatsen of indienen van Ledeninhoud verklaart en garandeert het Lid dat het Lid alle rechten op de Ledeninhoud bezit of anderszins controleert, met inbegrip van, maar niet beperkt tot, alle rechten die nodig zijn voor het Lid om de Ledeninhoud te verstrekken, te plaatsen, te uploaden, in te voeren of in te dienen. Voor zover de ingezonden Inhoud van de Leden auteursrechtelijk beschermde inhoud bevat, verklaart en garandeert het Lid dat:
(a) het Lid de auteursrechthebbende is van dergelijke inhoud, of dat de auteursrechthebbende het Lid toestemming heeft verleend om dergelijke inhoud te gebruiken in overeenstemming met de wijze en het doel van het gebruik door het Lid;
(b) het Lid beschikt over de nodige rechten om de in deze Voorwaarden beschreven licenties en sublicenties te verlenen; en
(c) dat elke persoon die is afgebeeld in dergelijke inhoud, indien van toepassing, toestemming heeft gegeven voor het gebruik van de inhoud. Intel behoudt zich het recht voor om een bewijs van eigendom of toestemming te vragen en te weigeren om Ledeninhoud te plaatsen zonder een dergelijk bewijs of indien een dergelijk bewijs, naar eigen goeddunken, onvoldoende is.
Het lid erkent dat Intel de ingediende Ledeninhoud al dan niet kan modereren of screenen. Intel en de door Intel aangewezen personen behouden zich het recht voor om naar eigen inzicht Ledeninhoud vooraf te screenen, te weigeren, te controleren, de toegang te beperken, te bewerken of te verwijderen van de Website. Zonder het voorgaande te beperken, behoudt Intel zich het recht voor (maar niet de verplichting) om Ledeninhoud te weigeren of te verwijderen waarvan Intel kennis neemt en naar eigen goeddunken oordeelt dat deze inbreuk maakt of anderszins illegaal of ongepast is, niet in overeenstemming is met deze Voorwaarden of niet voldoet aan de geest of het doel van de Website. Intel kan naar eigen goeddunken Ledeninhoud bewaren en kan ook Ledeninhoud openbaar maken als de wet of een gerechtelijk of overheidsmandaat dit vereist of als Intel dit redelijkerwijs nodig acht om de rechten, het eigendom of de persoonlijke veiligheid van de Website, de gebruikers en het publiek te beschermen.
Intel heeft geen controle over de Ledeninhoud die op de Website wordt geplaatst en geeft als zodanig geen garantie voor de nauwkeurigheid, integriteit of kwaliteit van dergelijke Ledeninhoud. In geen geval is Intel op enigerlei wijze aansprakelijk voor Ledeninhoud, inclusief maar niet beperkt tot aansprakelijkheid voor eventuele fouten of omissies in Ledeninhoud of voor enig verlies of schade van welke aard dan ook die het gevolg is van het gebruik van Ledeninhoud die is geplaatst, gemaild of anderszins verzonden via de Website.
Door inhoud in te dienen stemt het Lid ermee in dat de inzending gratis, ongevraagd en zonder beperkingen is en Intel niet onder een fiduciaire of andere verplichting plaatst, dat het Intel vrij staat de ideeën in de Inhoud van het Lid op niet-vertrouwelijke basis bekend te maken aan wie dan ook of de ideeën anderszins te gebruiken zonder aanvullende vergoeding. Het Lid erkent dat Intel, door de aanvaarding van de door het Lid ingediende ideeën, geen afstand doet van rechten op het gebruik van soortgelijke of verwante ideeën die eerder bekend waren bij Intel, of ontwikkeld zijn door haar werknemers, of verkregen zijn van andere bronnen dan het Lid.
Elk lid vrijwaart hierbij Intel en haar gelieerde ondernemingen en hun respectieve agentschappen, uitvoeringsbedrijven, verkopers, contractanten, deelnemende wederverkopers en reclame- en promotiebureaus en agenten, en al hun respectieve functionarissen, directeuren, aandeelhouders, werknemers en agenten (gezamenlijk "Gevrijwaarden") van en tegen alle verliezen, uitgaven, aansprakelijkheid, schade, claims (inclusief redelijke advocaatkosten) (gezamenlijk "Claims"), inclusief maar niet beperkt tot claims voor persoonlijk letsel, inclusief overlijden of materiële schade, die geheel of gedeeltelijk, direct of indirect, het gevolg zijn van aanvaarding, bezit, gebruik of misbruik van koopwaar of prijzen, deelname aan een programma-activiteit, of deelname of het niet kunnen deelnemen aan dit programma of een deel daarvan.
Elk Lid stemt er verder mee in om de Gevrijwaarden te vrijwaren en schadeloos te stellen van en tegen enige en alle Claims van derden als gevolg van of voortvloeiend uit enige en alle inhoud die het Lid indient, plaatst, verzendt of anderszins beschikbaar maakt via de Website, het gebruik van de Website door het Lid en ander gedrag gedurende het Programma, de verbinding van het Lid met de Website en het Programma, de schending door het Lid van deze Voorwaarden, of de schending door het Lid van enig recht van een ander.
DE DEELNAME VAN HET LID AAN HET PROGRAMMA, DE PROGRAMMAACTIVITEITEN EN HET GEBRUIK VAN DE WEBSITE IS GEHEEL VOOR RISICO VAN HET LID. ALLE ASPECTEN VAN HET PROGRAMMA WORDEN GELEVERD "ZOALS HET IS" EN "ZOALS BESCHIKBAAR". ENIGE EN ALLE GARANTIES VOOR PROGRAMMAMATERIAAL, PRIJZEN OF ONDERDELEN DAARVAN WORDEN UITSLUITEND GEBODEN DOOR DE GARANTIE VAN DE FABRIKANT VOOR DERGELIJKE PRODUCTEN, INDIEN VAN TOEPASSING. TENZIJ UITDRUKKELIJK ANDERS BEPAALD IN DEZE VOORWAARDEN, GEEFT INTEL GEEN VERKLARING OF GARANTIE DAT (1) HET PROGRAMMA OF DE DIENSTEN ERVAN VOLDOEN AAN DE VEREISTEN VAN HET LID, (2) DE TOEGANG VOOR LEDEN ONONDERBROKEN, TIJDIG, VEILIG OF VRIJ VAN FOUTEN IS, (3) DE KWALITEIT VAN DE INHOUD, PRODUCTEN, DIENSTEN, ACTIVITEITEN, EVENEMENTEN, INFORMATIE OF ANDER MATERIAAL VERKREGEN DOOR EEN LID ZAL VOLDOEN AAN ZIJN OF HAAR VERWACHTINGEN, (4) EVENTUELE FOUTEN IN DE SOFTWARE ZULLEN WORDEN GECORRIGEERD, EN (5) ALLE INHOUD DIE WORDT GEÜPLOAD NAAR DE WEBSITE IS BESCHERMD OF VEILIG, EN INTEL WIJST UITDRUKKELIJK ALLE GARANTIES VAN WELKE AARD DAN OOK AF MET BETREKKING TOT, GERELATEERD AAN OF ANDERSZINS VOORTKOMEND UIT HET PROGRAMMA, INCLUSIEF MAAR NIET BEPERKT TOT: (i) beëindiging van het programma, (ii) verwijdering, ongeoorloofde toegang tot of wijziging van het account van een lid, (iii) inhoud van het lid, (iv) gebruik van de website, (v) inhoud op de website, inclusief verklaringen of gedrag van derden op de website, (vi) DISKWALIFICATIE VAN EEN PROGRAMMAACTIVITEIT OF EVENEMENT, (vii) OF DE GARANTIES SCHRIFTELIJK, OORSPRONKELIJK, IMPLICIET OF WETTELIJK ZIJN, INCLUSIEF GARANTIES VAN VERKOOPBAARHEID OF GESCHIKTHEID VOOR EEN BEPAALD DOEL, NIETINVLOED OF GEBRUIK IN DE HANDEL.
IN GEEN GEVAL ZULLEN INTEL, HAAR GELIEERDE ONDERNEMINGEN OF HUN RESPECTIEVE FUNCTIONARISSEN, DIRECTEUREN, WERKNEMERS EN AGENTEN AANSPRAKELIJK ZIJN JEGENS EEN LID, OF IEMAND DIE VIA EEN LID CLAIMT, VOOR ENIGE DIRECTE, INDIRECTE, SPECIALE, GEVOLG- OF INCIDENTELE SCHADE, MET INBEGRIP VAN MAAR NIET BEPERKT TOT SCHADEVERGOEDING VOOR WINSTDERVING, VERLIES VAN GOODWILL, VERLIES VAN GEBRUIK, VERLIES VAN GEGEVENS, ONDERBREKING VAN ZAKEN, EN KOSTEN VAN AANSCHAF VAN VERVANGENDE PRODUCTEN, HOE DAN OOK VEROORZAAKT, HETZIJ DOOR INBREUK OP GARANTIE, CONTRACT, ONRECHTMATIGE DAAD, NALATIGHEID, STRIKTE AANSPRAKELIJKHEID OF ANDERSZINS (ZELFS ALS INTEL IS GEADVISEERD OVER DE MOGELIJKHEID VAN DERGELIJKE SCHADE), VOORTVLOEIEND UIT OF IN VERBAND STAAND MET HET PROGRAMMA, INCLUSIEF MAAR NIET BEPERKT TOT ALLE PROGRAMMA-ELEMENTEN DIE HIERBOVEN ZIJN OPGESOMD.
SOMMIGE RECHTSGEBIEDEN STAAN DE UITSLUITING VAN BEPAALDE GARANTIES OF DE BEPERKING OF UITSLUITING VAN AANSPRAKELIJKHEID VOOR INCIDENTELE SCHADE OF GEVOLGSCHADE NIET TOE. BIJGEVOLG ZIJN SOMMIGE VAN DE BOVENSTAANDE BEPERKINGEN MOGELIJK NIET VAN TOEPASSING OP LID.
Intel kan algemene praktijken en beperkingen vaststellen met betrekking tot het gebruik van de Website. Hoewel Intel redelijke inspanningen zal verrichten om een back-up te maken van sitegegevens en deze gegevens beschikbaar te stellen in geval van verlies of verwijdering, is Intel niet verantwoordelijk of aansprakelijk voor het verwijderen of niet opslaan van gegevens of andere inhoud die door anderen op de Website of een andere site van Intel wordt onderhouden of overgedragen. Intel behoudt zich het recht voor om Accounts en/of Ledeninhoud die gedurende langere tijd inactief is te verwijderen. Intel behoudt zich het recht voor om deze algemene praktijken te allen tijde naar eigen inzicht te wijzigen.
Intel logo's en dienstmerken, en product- en dienstnamen zijn Intel handelsmerken of geregistreerde handelsmerken in de Verenigde Staten en in andere landen (de "Intel Corporation Merken"). Deze Voorwaarden verlenen het Lid geen licentie in de handelsmerken van Intel of activa of intellectueel eigendom van Intel. Alle andere namen en ontwerpen kunnen handelsmerken zijn van hun respectievelijke eigenaren.
Intel respecteert de intellectuele eigendomsrechten van anderen en eist dat de mensen die de Website gebruiken hetzelfde doen. Het is het beleid van Intel om onmiddellijk te reageren op claims van misbruik van intellectueel eigendom. Indien het Lid van mening is dat zijn werk is gekopieerd en toegankelijk is op de Website op een manier die inbreuk maakt op het auteursrecht, kan het Lid Intel hiervan op de hoogte stellen via het DMCAproces dat hier te vinden is: http://www.intel.com/content/www/us/en/legal/dmca-notice-and-procedure.html
Indien Intel naar eigen goeddunken bepaalt dat het Lid een recidivist is onder de DMCA, kan de Ledenaccount worden gedeactiveerd, kan alle Ledeninhoud worden verwijderd en behoudt Intel zich het recht voor om alle andere maatregelen te nemen die zij nodig acht, waaronder het annuleren van het lidmaatschap van het Lid van het Programma en het in kennis stellen van de betreffende overheidsinstanties. Intel is niet verantwoordelijk voor inhoud van derden die wordt gedeeld op de Programmawebsite.
Deze Voorwaarden en de informatie op de Website met een hyperlink naar deze Voorwaarden vormen de volledige overeenkomst tussen het Lid en Intel met betrekking tot het Programma en zijn van toepassing op het gebruik van de Website door het Lid. Voor elk Lid kunnen aanvullende voorwaarden gelden die van toepassing kunnen zijn wanneer dat Lid deelneemt aan programma-activiteiten of gebruik maakt van geaffilieerde diensten, inhoud van derden of software. Indien een bepaling van deze Voorwaarden door een bevoegde rechtbank ongeldig wordt bevonden, komen de partijen niettemin overeen dat de rechtbank moet trachten uitvoering te geven aan de bedoelingen van de partijen zoals die in de bepaling tot uitdrukking komen, en blijven de overige bepalingen van de Voorwaarden volledig van kracht. De paragraaftitels in deze Voorwaarden zijn alleen voor het gemak en hebben geen wettelijke of contractuele gevolgen. De bepalingen van deze Voorwaarden waarvan redelijkerwijs kan worden verwacht dat zij na beëindiging van een Account van kracht blijven, zijn dat ook, met inbegrip van maar niet beperkt tot de volgende onderdelen: Ledenaccounts, Privacy en persoonlijke informatie, Ledencontent / Message Boards, Schadeloosstelling en vrijwaring, Afwijzing van garantie, Beperking van aansprakelijkheid en Algemene voorwaarden, die volledig van kracht blijven ondanks beëindiging van een Account of ander gebruik van of deelname aan het Programma door een Lid.
De Voorwaarden en de relatie tussen het Lid en Intel worden beheerst door de wetten van de staat Delaware, zonder rekening te houden met de bepalingen inzake wetsconflicten, en elke partij onderwerpt zich aan de persoonlijke en exclusieve jurisdictie van de rechtbanken in deze staat.
In het geval van een schending van deze Voorwaarden behoudt Intel zich het recht voor om voor dergelijke schendingen alle beschikbare rechtsmiddelen aan te wenden onder deze Voorwaarden en de wet en het eigen vermogen. Meld eventuele overtredingen van de Voorwaarden (met uitzondering van claims inzake inbreuk op auteursrechten, zie paragraaf 3 hierboven voor instructies) aan het Programma door contact op te nemen met Programma Support.
Intel kan deze Voorwaarden te allen tijde herzien door deze posting bij te werken. Leden dienen deze pagina van tijd tot tijd te bezoeken om de dan geldende Voorwaarden te bekijken, omdat deze bindend zijn voor Leden. Sommige bepalingen van deze Voorwaarden kunnen worden vervangen door expliciet aangegeven wettelijke kennisgevingen of voorwaarden op de Website, bepaalde activiteiten of materialen.

Les présentes Conditions générales (ci-après les « Conditions ») s’appliquent au programme Intel® Skills for Innovation (ci-après le « Programme »), à l’ensemble du contenu des cours, notamment, sans s’y limiter, la plate-forme d’hébergement en ligne (ci-après le « Site Web »), ainsi qu’à l’ensemble du contenu, des activités et/ou des tableaux de bord du Site Web, notamment, sans s’y limiter, les webinaires, les concours, les articles, les discussions et le contenu généré par la communauté, notamment le contenu qui peut être disponible maintenant et/ou de temps à autre et/ou qui pourrait l’être à l’avenir. Certaines activités ou ressources peuvent contenir des conditions spécifiques en plus des présentes Conditions. En cas de conflit entre ces conditions spécifiques et les présentes Conditions, les conditions spécifiques de ces activités ou ressources prévaudront.
En participant au Programme, chaque Établissement scolaire et chaque Membre reconnaissent qu’ils ont lu et accepté les présentes Conditions et qu’ils répondent à tous les critères d’admissibilité au Programme énoncés dans les présentes Conditions.
Le programme Intel® Skills for Innovation est conçu pour les établissements scolaires de la maternelle à la terminale (ou équivalent). L’admissibilité exige également :
- La signature du Contrat de licence de contenu Intel® SFI.
Les établissements scolaires qui remplissent les conditions ci-dessus (chacun étant un « Établissement scolaire agréé ») peuvent participer au Programme.
Pour être admissible en tant que membre du Programme (ci-après « Membre ») et pouvoir participer au Programme, les personnes doivent remplir les conditions d’admissibilité suivantes (sauf si Intel leur accorde des conditions d’admissibilité différente) :
La détermination finale de l’admissibilité et de l’attribution des niveaux du Programme aux Établissements scolaires agréés est à la seule discrétion d’Intel Corporation (ci-après « Intel »).
Les Membres doivent être employés au moment de tous les aspects de la participation au Programme (ou de certaines parties de celui-ci) dans un Établissement scolaire agréé. Les membres d’un Établissement scolaire agréé qui a été désactivé du Programme ne sont pas admissibles.
Si un Établissement scolaire agréé devient incompatible avec le Programme, tel que déterminé par Intel, il peut être disqualifié et retiré du Programme ou peut être réaffecté à un programme différent à la seule discrétion d’Intel.
Une fois qu’une décision de disqualification ou de réaffectation a été prise, les Membres employés par cet établissement recevront un courrier électronique contenant une notification de 90 jours de désactivation ou de réaffectation de l’établissement et de tous les Comptes de Membre (définis ci-dessous) inscrits au programme par le biais de cet établissement. En outre, les Membres dont la vérification de l’emploi est en cours verront leur vérification renouvelée pour 90 jours supplémentaires. Pendant cette période de 90 jours, les Membres peuvent continuer à participer à tous les aspects du Programme auxquels ils sont admissibles.
Si un Membre a obtenu un emploi dans un autre établissement admissible, il devra mettre à jour son compte avec les informations correctes au cours de la période de 90 jours pour que son compte reste actif.
Afin de participer au Programme, chaque Membre doit s’inscrire et créer un Compte de Membre (ci-après « Compte »). Le nombre de Comptes actifs est limité à un (1) par Membre. Pour s’inscrire, chaque Membre doit :
Remarque : Le changement de nom d’un Membre ne sera autorisé qu’à la seule discrétion d’Intel, au cas par cas.
Les Membres devront saisir un mot de passe pendant la procédure d’inscription. Les Membres sont seuls responsables du maintien de la confidentialité de leur mot de passe et de leur nom d’utilisateur. Les Membres sont responsables de toutes les activités liées à leur Compte. Les membres doivent informer immédiatement Intel, par le biais du service d’assistance en ligne, de tout soupçon d’utilisation non autorisée ou de toute autre violation de la sécurité de leur Compte.
Intel ne sera pas responsable d’une quelconque perte subie à la suite d’une utilisation non autorisée. Toutefois, le Membre peut être tenu responsable des pertes subies par Intel ou une autre partie en raison d’une utilisation non autorisée du Compte du Membre.
Si un Membre souhaite fermer son Compte ou en supprimer le contenu associé, il devra en faire la demande en contactant le service d’assistance. Une fois qu’un Compte est désactivé, les Membres ne pourront plus participer à aucun aspect du Programme. Un Compte désactivé peut être rétabli sur demande, au cas par cas, à la seule discrétion d’Intel.
Intel peut résilier le Compte d’un Membre à son entière discrétion et pour quelque raison que ce soit. Les activités qui peuvent entraîner la résiliation du Compte d’un Membre du Programme comprennent, sans s’y limiter :
La résiliation par Intel de l’accès au Compte du Membre peut être effectuée sans préavis et, lors de cette résiliation, Intel peut immédiatement désactiver ou supprimer le Compte du Membre et/ou interdire tout accès ultérieur. Intel ne sera pas responsable d’une quelconque résiliation de Compte ou d’accès envers un Membre ou un tiers. Ces Conditions resteront pleinement en vigueur et effectives nonobstant toute résiliation de Compte.
La conduite des Membres doit être guidée par le bon sens, le comportement professionnel et l’étiquette de base, ainsi que par les présentes Conditions et toute autre condition spécifique à une activité du Programme. Les Membres doivent également respecter les lois nationales, locales, fédérales et internationales, le cas échéant.
L’usurpation de l’identité d’autres utilisateurs ou Membres ou l’envoi de fausses informations de vérification est considérée comme une activité frauduleuse qui entraînera la résiliation du Compte du Membre et pourrait entraîner l’interdiction permanente du Membre du Programme. Intel se réserve le droit de poursuivre en justice toute personne se livrant à une activité frauduleuse ou illégale.

Intel ne partagera pas les informations relatives à un Membre avec d’autres personnes ou sociétés sans l’autorisation du Membre, à l’exception du fait qu’Intel peut partager les informations personnelles d’un Membre en interne ou avec ses agences autorisées si cela s’avère nécessaire (selon Intel), pour l’administration du Programme ou pour fournir des communications liées au Programme.
La participation au Programme peut inclure des activités supplémentaires organisées par Intel ou par Intel en association avec des partenaires, notamment, sans s’y limiter, des concours pour enseignants, des webinaires, des enquêtes et d’autres activités. Ces activités peuvent inclure des promotions de solutions technologiques par Intel ou ses partenaires.
Intel s’engage à respecter votre vie privée. En choisissant de participer à ce Programme, vous pouvez fournir à Intel les informations personnelles incluses dans le formulaire d’inscription. Si un Membre n’a pas mené à bien une activité (apprentissage terminé, article consulté, ressource consultée, ressource téléchargée) au cours des 180 derniers jours, il est considéré comme inactif. Le Compte du Membre restera inactif jusqu’à ce que le Membre termine une activité d’apprentissage.
Après deux ans (730 jours), les Comptes inactifs peuvent être purgés.
Intel peut mettre fin au Programme avec un préavis de 90 jours sur le Site Web du Programme. Intel peut, à sa seule discrétion, amender ou modifier les présentes Conditions, notamment les conditions d’adhésion au Programme.
Le Site Web peut héberger ou faciliter des activités ou des services dans le but de permettre aux Membres de partager publiquement du contenu, des idées et des documents (ci-après le « Contenu de Membre »). L’utilisation de ces services et activités est limitée aux Membres admissibles et est régie par les présentes Conditions et toute autre condition spécifique à l’activité du Programme fournie.
Intel ne revendique pas la propriété d’un quelconque Contenu de Membre envoyé, publié, transmis, mis à disposition ou affiché sur le Site Web ou par son biais, notamment, sans s’y limiter, les données, textes, sons, images, vidéos, schémas, fichiers audio, informations, graphiques ou descriptions sur le Site Web. Sauf accord écrit contraire, le Contenu de Membre ne donne lieu à aucune rémunération. Intel n’a aucune obligation de publier ou d’utiliser le Contenu de Membre envoyé et peut supprimer tout Contenu de Membre à tout moment à sa seule discrétion.
En publiant, téléchargeant, saisissant, fournissant ou envoyant d’une quelconque autre manière le Contenu de Membre, le Membre accorde à Intel, à ses filiales, à ses sous-traitants et aux utilisateurs du Site Web, une licence mondiale, non exclusive, perpétuelle, irrévocable, libre de redevance, transférable et pouvant faire l’objet d’une sous-licence, pour reproduire, modifier, créer des travaux dérivés, afficher publiquement, exécuter publiquement, divulguer, distribuer, fournir sous licence et sous sous-licence, incorporer et utiliser d’une quelconque autre manière le Contenu de Membre et toutes les données, images, sons, textes et autres éléments qui y sont incorporés (en tout ou en partie) et pour incorporer ce Contenu de Membre dans d’autres travaux sous tout format ou support connu à l’heure actuelle ou développé ultérieurement à toutes fins commerciales ou non commerciales.
Tout le Contenu de Membre, qu’il soit affiché publiquement ou transmis en privé, relève de la seule responsabilité du Membre qui en est à l’origine. Autrement dit, le Membre, et non Intel, est entièrement responsable de tout contenu qu’il télécharge, publie, partage ou affiche de toute autre manière via le Programme ou le Site Web. Il est interdit au Membre de publier ou de transmettre tout contenu illégal, menaçant, diffamatoire, obscène ou autre qui violerait une loi.
En publiant ou en envoyant un Contenu de Membre, le Membre déclare et garantit qu’il possède ou contrôle de toute autre manière tous les droits sur le Contenu de Membre, notamment, sans s’y limiter, tous les droits nécessaires pour que le Membre fournisse, publie, télécharge, saisisse ou envoie le Contenu de Membre. Dans la mesure où le Contenu de Membre envoyé contient un contenu protégé par des droits d’auteur, le Membre déclare et garantit que :
(a) le Membre est le propriétaire des droits d’auteur de ce contenu, ou que le propriétaire des droits d’auteur a accordé au Membre la permission d’utiliser ce contenu conformément au mode et aux fins d’utilisation par le Membre ;
(b) le Membre dispose des droits nécessaires pour accorder les licences et sous-licences décrites dans les présentes Conditions ; et
(c) chaque personne représentée dans ce contenu, le cas échéant, a donné son consentement à l’utilisation de ce contenu. Intel se réserve le droit de demander une preuve de propriété ou d’autorisation, et de refuser de publier le Contenu de Membre sans cette preuve ou si cette preuve n’est pas, à sa seule discrétion, suffisante.
Le Membre reconnaît qu’Intel peut ou non modérer ou présélectionner le Contenu de Membre envoyé. Intel et ses représentants conservent le droit, à la seule discrétion d’Intel, de présélectionner, de refuser, de surveiller, de restreindre l’accès à, de modifier ou de supprimer tout Contenu de Membre sur le Site Web. Sans limiter ce qui précède, Intel se réserve le droit (mais pas l’obligation) de refuser ou de supprimer tout Contenu de Membre dont elle a connaissance et qu’elle considère, à sa seule discrétion, comme contrefaisant ou comme étant autrement illégal, inapproprié, non conforme aux présentes Conditions ou ne correspondant pas à l’esprit ou à la finalité du Site Web. Intel, à sa seule et absolue discrétion, peut conserver le Contenu de Membre et peut également le divulguer si la loi ou un mandat judiciaire ou gouvernemental l’exige ou si Intel le juge raisonnablement utile pour protéger les droits, la propriété ou la sécurité personnelle du Site Web, de ses utilisateurs et du public.
Intel ne contrôle pas le Contenu de Membre publié sur le Site Web et, en tant que tel, n’en garantit pas l’exactitude, l’intégrité ou la qualité. En aucun cas Intel ne sera responsable de quelque manière que ce soit du Contenu de Membre, notamment, sans s’y limiter, vis-à-vis d’une quelconque erreur ou omission dans le Contenu de Membre ou d’une quelconque perte ou dommage de quelque nature que ce soit résultant de l’utilisation de tout Contenu de Membre publié, envoyé par courrier électronique ou transmis de toute autre manière via le Site Web.

En acceptant l’envoi de son contenu, le Membre reconnaît qu’Intel ne renonce à aucun droit d’utiliser des idées similaires ou connexes précédemment connues d’Intel, ou développées par ses employés, ou obtenues de sources autres que le Membre.
Par les présentes, chaque Membre indemnise et accepte de dégager de toute responsabilité Intel et ses filiales, ainsi que leurs agences, sociétés d’exécution, vendeurs, sous-traitants, revendeurs participants et agences et agents publicitaires et promotionnels respectifs, et tous leurs dirigeants, administrateurs, actionnaires, employés et agents respectifs (collectivement, les « Indemnisés ») contre toute perte, dépense, responsabilité, dommage, réclamation (y compris les honoraires raisonnables d’avocat) (collectivement, les « Réclamations »), notamment, sans s’y limiter, les Réclamations pour dommages corporels, notamment le décès ou les dommages matériels, découlant en tout ou en partie, directement ou indirectement, de l’acceptation, de la possession, de l’utilisation ou de la mauvaise utilisation des marchandises ou des prix, de la participation à toute activité du Programme ou de la participation ou de l’incapacité à participer à ce Programme ou à toute partie de celui-ci.
Chaque Membre accepte en outre d’indemniser et de dégager de toute responsabilité les Indemnisés de toute réclamation faite par un tiers en raison de ou découlant de tout contenu que le Membre envoie, affiche, transmet ou rend autrement disponible par le biais du Site Web, de l’utilisation du Site Web par le Membre et de toute autre conduite dans le cadre du Programme, de la connexion du Membre au Site Web et au Programme, de la violation par le Membre des présentes Conditions ou de la violation par le Membre des droits d’un tiers.
LA PARTICIPATION DU MEMBRE AU PROGRAMME, AUX ACTIVITÉS DU PROGRAMME ET À L’UTILISATION DU SITE WEB SE FAIT AUX SEULS RISQUES DU MEMBRE. TOUS LES ASPECTS DU PROGRAMME SONT FOURNIS « TELS QUELS » ET « SELON DISPONIBILITÉ ». TOUTE GARANTIE POUR LES MARCHANDISES DU PROGRAMME, LES PRIX OU LEURS PARTIES EST FOURNIE UNIQUEMENT PAR LA GARANTIE DU FABRICANT DE CES PRODUITS, LE CAS ÉCHÉANT. SAUF DISPOSITION CONTRAIRE EXPRESSE DANS LES PRÉSENTES CONDITIONS, INTEL NE FAIT AUCUNE DÉCLARATION ET NE DONNE AUCUNE GARANTIE QUANT AU FAIT QUE (1) LE PROGRAMME OU TOUT SERVICE Y AFFÉRENT RÉPONDRA AUX EXIGENCES DU MEMBRE, (2) L’ACCÈS DU MEMBRE SERA ININTERROMPU, OPPORTUN, SÛR OU SANS ERREUR, (3) LA QUALITÉ DU CONTENU, DES PRODUITS, DES SERVICES, DES ACTIVITÉS, DES ÉVÉNEMENTS, DES INFORMATIONS OU DE TOUT AUTRE SUPPORT OBTENU PAR UN MEMBRE RÉPONDRA À SES ATTENTES, (4) TOUTE ERREUR DANS LE LOGICIEL SERA CORRIGÉE, ET (5) TOUT CONTENU TÉLÉCHARGÉ SUR LE SITE WEB EST PROTÉGÉ OU SÉCURISÉ, ET INTEL DÉCLINE EXPRESSÉMENT TOUTE GARANTIE DE QUELQUE NATURE QUE CE SOIT CONCERNANT LE PROGRAMME, S’Y RAPPORTANT OU EN DÉCOULANT, NOTAMMENT, SANS S’Y LIMITER : (i) LA RÉSILIATION DU PROGRAMME, (ii) LA SUPPRESSION, L’ACCÈS NON AUTORISÉ OU L’ALTÉRATION DU COMPTE D’UN MEMBRE, (iii) LE CONTENU DE MEMBRE, (iv) L’UTILISATION DU SITE WEB, (v) LE CONTENU DU SITE WEB, NOTAMMENT LES DÉCLARATIONS OU LA CONDUITE DE TOUT TIERS SUR LE SITE WEB, (vi) LA DISQUALIFICATION D’UNE ACTIVITÉ OU D’UN ÉVÉNEMENT DU PROGRAMME, (vii) QUE CES GARANTIES SOIENT ÉCRITES, ORALES, IMPLICITES OU STATUTAIRES, NOTAMMENT LES GARANTIES DE QUALITÉ MARCHANDE OU D’ADÉQUATION À UN USAGE PARTICULIER, D’ABSENCE DE CONTREFAÇON OU RÉSULTANT D’UN USAGE COMMERCIAL.
EN AUCUN CAS INTEL, SES FILIALES OU LEURS DIRIGEANTS, DIRECTEURS, EMPLOYÉS ET AGENTS RESPECTIFS NE POURRONT ÊTRE TENUS RESPONSABLES ENVERS TOUT MEMBRE, OU TOUTE PERSONNE FAISANT UNE RÉCLAMATION PAR L’INTERMÉDIAIRE D’UN MEMBRE, POUR TOUT DOMMAGE DIRECT, INDIRECT, SPÉCIAL, CONSÉCUTIF OU ACCESSOIRE, NOTAMMENT, SANS S’Y LIMITER, LES DOMMAGES POUR PERTE DE PROFITS, PERTE DE CLIENTÈLE, PERTE D’UTILISATION, PERTE DE DONNÉES, INTERRUPTION D’ACTIVITÉ ET COÛT D’OBTENTION DE SUBSTITUTS, QUELLE QU’EN SOIT LA CAUSE, QU’IL S’AGISSE D’UNE VIOLATION DE GARANTIE, D’UN CONTRAT, D’UN DÉLIT, D’UNE NÉGLIGENCE, D’UNE RESPONSABILITÉ STRICTE OU AUTRE (MÊME SI INTEL A ÉTÉ INFORMÉE DE LA POSSIBILITÉ DE TELS DOMMAGES), DÉCOULANT DE OU LIÉS DE QUELQUE MANIÈRE QUE CE SOIT AU PROGRAMME, NOTAMMENT, SANS S’Y LIMITER, TOUS LES ÉLÉMENTS DU PROGRAMME ÉNUMÉRÉS CI-DESSUS.
CERTAINES JURIDICTIONS N’AUTORISENT PAS L’EXCLUSION DE CERTAINES GARANTIES OU LA LIMITATION OU L’EXCLUSION DE LA RESPONSABILITÉ POUR LES DOMMAGES ACCESSOIRES OU INDIRECTS. PAR CONSÉQUENT, CERTAINES DES LIMITATIONS CI-DESSUS PEUVENT NE PAS S’APPLIQUER AU MEMBRE.

Les présentes Conditions et les informations du Site Web qui renvoient par hyperliens aux présentes Conditions constituent l’intégralité du contrat entre le Membre et Intel concernant le Programme et régissent l’utilisation du Site Web par les Membres. Chaque Membre peut être soumis à des conditions générales supplémentaires qui peuvent s’appliquer lorsque ce Membre participe aux activités du Programme ou utilise des services affiliés, du contenu ou des logiciels tiers. Les conditions et la relation entre le Membre et Intel sont régies par les lois de l’État du Delaware, sans tenir compte des dispositions relatives aux conflits de lois, et chaque partie doit se soumettre à la juridiction personnelle et exclusive des tribunaux situés dans cet État.
En cas de violation des présentes Conditions, Intel se réserve le droit de chercher tous les recours disponibles dans le cadre des présentes Conditions et en droit et en équité pour ces violations. Certos recursos ou atividades do Programa podem conter termos específicos além destes Termos. No caso de conflito entre tais termos específicos e estes Termos, os termos específicos de tais recursos ou atividades do Programa prevalecerão.
Ao participar do Programa, cada instituição educacional e cada membro afirma que leu e aceita estes Termos, e que atende a todos os critérios de elegibilidade do Programa aqui estabelecidos.
O Intel® Skills for Innovation foi desenvolvido para escolas de ensino fundamental e médio (ou seu equivalente). Os requisitos adicionais de elegibilidade incluem:
- Assinatura do contrato de licença do conteúdo Intel® SFI.
As instituições educacionais que atendem aos requisitos acima (“Instituição Educacional Aprovada”) são elegíveis para participar do Programa.
Para se qualificar como membro do Programa (“Membro”) e ser elegível para participar nele, os indivíduos devem atender aos seguintes requisitos de elegibilidade (a menos que a Intel conceda elegibilidade de outra forma):
A determinação final da elegibilidade e a atribuição do nível do Programa de Instituição Educacional Aprovada fica a critério exclusivo da Intel Corporation (“Intel”).
Os Membros devem estar empregados no momento de todos os aspectos da participação no Programa (ou partes dele) em uma Instituição Educacional Aprovada. Membros de uma instituição desativada não são elegíveis para o Programa.
Uma Instituição Educacional Aprovada pode ser desqualificada e removida do Programa caso se torne incompatível com o Programa conforme determinado pela Intel, ou a Instituição Educacional Aprovada pode ser transferida para um programa diferente, a critério exclusivo da Intel.
Assim que uma determinação de desqualificação ou reatribuição do Programa for feita, os Membros empregados nessa Instituição receberão um e-mail, com um aviso prévio de 90 dias de desativação ou reatribuição da instituição e de todas as Contas dos Membros (definidas abaixo) registradas no Programa sob essa organização. Além disso, os Membros com emprego verificado atual terão sua verificação renovada por mais 90 dias. Durante esse período, eles podem continuar participando de todos os aspectos do Programa para os quais são elegíveis.
Se um Membro obtiver emprego em outra organização qualificada, ele precisará atualizar sua Conta com as informações corretas dentro do período de 90 dias para mantê-la ativa.
Para participar do Programa, cada Membro deve se registrar e estabelecer uma Conta do Programa (“Conta”). Os Membros estão limitados a uma (1) Conta ativa por pessoa. Para se inscrever, é preciso:
Observação: as alterações de nome do Membro só serão permitidas a critério exclusivo da Intel, caso a caso.
Os Membros precisarão inserir uma senha durante os processos de registro; são os únicos responsáveis por manter a confidencialidade do nome de usuário e da senha; são responsáveis por toda e qualquer atividade que aconteça em sua Conta; devem notificar a Intel, por meio do suporte técnico on-line, imediatamente sobre qualquer suspeita de uso não autorizado ou outra violação de segurança em sua Conta.
A Intel não será responsável por qualquer perda ocorrida como resultado de uso não autorizado. No entanto, o Membro pode ser responsabilizado por perdas ocorridas pela Intel ou outra parte, devido ao uso não autorizado da Conta do Membro.
Se um Membro desejar encerrar sua Conta ou remover o conteúdo que enviou, a solicitação deve ser feita entrando em contato com o suporte técnico. Após uma Conta ser desativada, os Membros não poderão participar de nenhum aspecto do Programa. Uma Conta desativada pode ser restabelecida mediante solicitação caso a caso, a critério exclusivo da Intel.
A Intel pode rescindir a Conta de um Membro a seu critério absoluto e por qualquer motivo. As atividades que podem resultar da rescisão da Conta de um Membro do Programa incluem, mas não se limitam a:
A rescisão pela Intel do acesso à Conta do Membro pode ser efetuada sem aviso prévio e, em tal rescisão, a Intel pode desativar ou excluir imediatamente a Conta do Membro e/ou barrar qualquer acesso posterior. A Intel não será responsável perante qualquer Membro ou terceiro por qualquer Conta ou rescisão de acesso. Estes Termos permanecerão em pleno vigor e efeito, independentemente de qualquer rescisão da Conta.
A conduta do Membro deve ser guiada pelo bom senso, por um comportamento profissional e pela etiqueta básica, bem como por estes Termos e quaisquer outros termos específicos de atividades do Programa. Os Membros também devem obedecer às leis estaduais, locais, federais e internacionais, quando aplicáveis.
Usar a identidade de outros usuários ou Membros, ou enviar informações de verificação falsas é considerado atividade fraudulenta e resultará na rescisão da conta do Membro, e pode resultar no banimento permanente de um Membro do Programa. A Intel reserva-se o direito de processar qualquer indivíduo envolvido em atividades fraudulentas ou ilegais.

Se um Membro não tiver concluído com sucesso uma atividade (aprendizagem concluída, artigo visualizado, recurso acessado, recurso carregado) nos 180 dias anteriores, ele será considerado inativo. A Conta do Membro permanecerá inativa até que ele conclua uma atividade de aprendizagem.
Após dois anos (730 dias), as contas inativas podem ser removidas.
A Intel pode encerrar o Programa com aviso prévio de 90 dias no Site do Programa. A Intel pode, a seu exclusivo critério, alterar estes Termos, incluindo as condições de associação do Programa.
O Site pode hospedar ou facilitar atividades ou serviços com a finalidade de permitir que os Membros compartilhem conteúdo, ideias e materiais publicamente (o “Conteúdo do Membro”). O uso desses serviços e atividades é limitado a Membros qualificados e é regido por estes Termos e quaisquer outros termos específicos de atividades do Programa fornecidos.
A Intel não reivindica a propriedade de nenhum Conteúdo do Membro enviado, publicado, transmitido, disponibilizado ou exibido no ou através do Site, incluindo, mas sem limitação, dados, texto, sons, imagens, vídeos, diagramas, áudio, informações, gráficos ou descrições no Site. Salvo acordo em contrário por escrito, não há compensação pelo Conteúdo do Membro. A Intel não tem obrigação de publicar ou usar qualquer Conteúdo do Membro enviado e pode remover qualquer Conteúdo do Membro a qualquer momento, a seu exclusivo critério.
Ao publicar, carregar, inserir, fornecer ou enviar Conteúdo do Membro, o Membro concede à Intel, suas empresas afiliadas, sublicenciados e usuários do Site, uma licença mundial, não exclusiva, perpétua, irrevogável, isenta de royalties, transferível e sublicenciável, para reproduzir, modificar, criar trabalhos derivados, exibir publicamente, executar publicamente, divulgar, distribuir, licenciar e sublicenciar, incorporar e usar o Conteúdo do Membro e todos os dados, imagens, sons, texto e outras coisas nele incorporadas (no todo ou em parte) e incorporar tal conteúdo em outros trabalhos em qualquer formato, meio conhecido ou desenvolvido posteriormente para todo e qualquer propósito comercial ou não comercial.
Todo o Conteúdo do Membro, seja enviado publicamente ou transmitido de forma privada, é de responsabilidade exclusiva do Membro de quem esse conteúdo se originou. Isso significa que o Membro, e não a Intel, é inteiramente responsável por todo e qualquer conteúdo que carregar, publicar, compartilhar ou exibir por meio do Programa ou Site. É proibido publicar ou transmitir qualquer material ilegal, ameaçador, calunioso, difamatório, obsceno ou outro material que viole qualquer lei.
Ao publicar ou enviar Conteúdo do Membro, o Membro declara e garante que possui ou controla todos e quaisquer direitos relativos ao conteúdo, incluindo, mas sem limitação, todos os direitos necessários para o Membro fornecer, publicar, carregar, inserir ou enviar o conteúdo. Na medida em que o Conteúdo do Membro enviado está protegido por direitos autorais, o membro representa e garante que:
(a) É o proprietário dos direitos autorais de tal conteúdo, ou que o proprietário dos direitos autorais concedeu a ele permissão para usar tal conteúdo de acordo com a forma e propósito de uso do Membro;
(b) Ele tem os direitos necessários para conceder as licenças e sublicenças descritas nestes Termos;
(c) Cada pessoa retratada em tal conteúdo, se houver, deu consentimento para o uso do conteúdo. A Intel reserva-se o direito de solicitar uma prova de propriedade ou permissão e de se recusar a publicar o Conteúdo do Membro sem tal prova ou se tal prova não for, a seu exclusivo critério, suficiente.
O Membro reconhece que a Intel pode ou não moderar ou pré-selecionar o conteúdo enviado. A Intel e seus designados retêm o direito, a critério exclusivo, de pré-selecionar, recusar, monitorar, restringir o acesso, editar ou eliminar qualquer Conteúdo do Membro do Site. Sem limitar o precedente, a Intel se reserva o direito (mas não a obrigação) de recusar ou excluir qualquer Conteúdo do Membro do qual tenha conhecimento e, a seu exclusivo critério, considere infringir ou de outra forma ser ilegal, como inadequado, não compatível com estes Termos, ou que não cumpra o espírito ou propósito do Site. A Intel, a seu exclusivo e absoluto critério, pode preservar o Conteúdo do Membro e também pode divulgá-lo se exigido por lei ou mandado judicial ou governamental, ou conforme razoavelmente determinado como útil pela Intel para proteger os direitos, propriedade ou segurança pessoal do Site, seus usuários e o público.
A Intel não controla o Conteúdo do Membro publicado no Site e, como tal, não garante a precisão, integridade ou qualidade de tal conteúdo do Membro. Sob nenhuma circunstância a Intel será responsável por qualquer Conteúdo do Membro, incluindo, sem limitação, a responsabilidade por quaisquer erros ou omissões em qualquer conteúdo do Membro, ou por qualquer perda ou dano de qualquer tipo ocorrido como resultado do uso de qualquer conteúdo do Membro publicado, enviado por e-mail ou transmitido de outra forma através do Site.
Ao enviar o conteúdo, o Membro concorda que sua divulgação é gratuita, não solicitada e sem restrições, e não colocará a Intel sob nenhuma obrigação fiduciária ou outra; que a empresa é livre para divulgar as ideias do Conteúdo do Membro de forma não confidencial a qualquer pessoa; ou usar de outra forma as ideias sem qualquer compensação adicional. O Membro reconhece que, ao aceitar o envio, a Intel não renuncia a nenhum direito de usar ideias semelhantes ou relacionadas anteriormente pela Intel, desenvolvidas por seus funcionários, ou obtidas de outras fontes que não o membro.

A PARTICIPAÇÃO DO MEMBRO NO PROGRAMA, ATIVIDADES DO PROGRAMA E USO DO SITE É DE RISCO EXCLUSIVO DO MEMBRO. TODOS OS ASPECTOS DO PROGRAMA SÃO FORNECIDOS "COMO ESTÃO" E "CONFORME DISPONÍVEIS". TODAS E QUAISQUER GARANTIAS PARA MERCADORIAS DO PROGRAMA, PRÊMIOS OU PEÇAS DELE SÃO FORNECIDAS APENAS PELA GARANTIA DO FABRICANTE PARA TAIS PRODUTOS, SE HOUVER. EM NENHUMA HIPÓTESE A INTEL, SUAS AFILIADAS OU QUALQUER UM DOS SEUS RESPECTIVOS DIRETORES, FUNCIONÁRIOS E AGENTES SERÃO RESPONSÁVEIS PERANTE QUALQUER MEMBRO, OU QUALQUER PESSOA QUE RECLAME ATRAVÉS DE UM MEMBRO, POR QUAISQUER DANOS DIRETOS, INDIRETOS, ESPECIAIS, CONSEQUENCIAIS OU INCIDENTAIS, INCLUINDO, MAS SEM LIMITAÇÃO, DANOS POR PERDA DE LUCROS, DE FUNDOS, DE USO, DE DADOS, INTERRUPÇÃO DE NEGÓCIOS E CUSTO DE AQUISIÇÃO DE SUBSTITUTOS, SEJA COMO CAUSADO OU POR QUEBRA DE GARANTIA, CONTRATO, ATO ILÍCITO, NEGLIGÊNCIA, RESPONSABILIDADE ESTRITA OU DE OUTRA FORMA (MESMO QUE A INTEL TENHA SIDO AVISADA DA POSSIBILIDADE DE TAIS DANOS), DECORRENTES OU RELACIONADOS DE QUALQUER FORMA AO PROGRAMA, INCLUINDO, SEM LIMITAÇÃO, TODOS OS ELEMENTOS DO PROGRAMA LISTADOS ACIMA.
ALGUMAS JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO DE CERTAS GARANTIAS OU A LIMITAÇÃO OU EXCLUSÃO DE RESPONSABILIDADE POR DANOS INCIDENTAIS OU CONSEQUENTES. ASSIM, ALGUMAS DAS LIMITAÇÕES ACIMA PODEM NÃO SE APLICAR AO MEMBRO.
A Intel pode estabelecer práticas gerais e limites relativos ao uso do Site. Embora a Intel realize esforços razoáveis para fazer backup dos dados do Site e disponibilizá-los em caso de perda ou exclusão, a Intel não tem responsabilidade ou obrigação pela exclusão ou falha no armazenamento de quaisquer dados ou outros conteúdos, mantidos ou transmitidos por terceiros, no Site ou qualquer outro site da Intel. A Intel reserva-se o direito de limpar Contas e/ou Conteúdo do Membro que estiver inativo por um longo período de tempo. A Intel reserva-se o direito de alterar essas práticas gerais a qualquer momento, a seu exclusivo critério.
Os logotipos e marcas de serviço da Intel e os nomes de produtos e serviços são marcas comerciais ou marcas registradas da Intel nos Estados Unidos e em outros países (“marcas da Intel Corporation”). Estes Termos não concedem ao membro nenhuma licença sobre as marcas registradas da Intel ou quaisquer ativos ou propriedade intelectual da Intel. Todos os outros nomes e designs podem ser marcas registradas de seus respectivos proprietários.
A Intel respeita os direitos de propriedade intelectual de terceiros e exige que as pessoas que usem o Site façam o mesmo. Se a Intel determinar, a seu exclusivo critério, que o Membro é um infrator reincidente sob a DMCA, a Conta do Membro pode ser desativada, todo o Conteúdo do Membro removido, e a Intel se reserva o direito de tomar quaisquer outras ações que julgar necessárias, incluindo o cancelamento da associação do Membro no Programa e a notificação às autoridades governamentais competentes. Estes Termos e as informações no Site que estão vinculadas a estes Termos constituem o acordo integral entre o Membro e a Intel em relação ao Programa e regem o uso do Site pelo Membro. 本プログラムに参加することにより、各教育機関および各会員は、本規約 を読み、本規約に同意し、本規約に定められているすべての本プログラム への参加資格基準を満たしていることを確認したものとします。
Intel® Skills for Innovation は、⼩学校から⾼等学校まで向けに設計さ れています。その他の資格要件には、次のものが含まれます。

個⼈がプログラムの会員（「会員」）としての資格を取得し、本プログラ ムへの参加資格を得るには、次の資格要件を満たしている必要があります （インテルから別途資格を付与されている場合を除きます）。
資格要件を満たすかどうかおよび認定教育機関に対する本プログラムのレ ベルの割り当てに関する最終決定は、Intel Corporation（「インテル」） の独⾃の裁量によります。
会員は、本プログラム（またはその⼀部）への参加のすべての場⾯におい て、全期間中、認定教育機関で雇⽤されている必要があります。本プログ ラムへの参加を停⽌された認定教育機関に雇⽤されている会員は、資格要 件を満たしません。
本プログラムと相容れないとインテルに判断された認定教育機関は、失格 となり、本プログラムから除外されることがあります。あるいは、インテ ルの独⾃の裁量により、別の本プログラムが再度割り当てられることがあ ります。
認定教育機関に対する失格の決定または本プログラムの再割り当てがなさ れると、当該機関に雇⽤されている会員には、当該機関および当該機関の 下で本プログラムに登録されているすべての会員アカウント（以下に定義 します）の無効化または再割り当てに関する 90 ⽇間の通知が電⼦メール で送信されます。また、その時点で当該機関からの雇⽤証明のある会員の 雇⽤証明は、さらに 90 ⽇間、更新されます。この 90 ⽇間の期間中、会 員は、参加資格を有するすべての本プログラムへの参加を継続することが できます。
会員が参加資格を有する他の機関に就職した場合、そのアカウントを有効 に保つためには、90 ⽇以内に正しい情報を⼊⼒してアカウントを更新す る必要があります。
本プログラムに参加するには、各会員は本プログラムのアカウント（「ア カウント」）を作成し、登録する必要があります。会員が保有することが できる有効なアカウントは、1 ⼈につき 1 つに制限されています。アカウ ントを登録するには、各会員は、次のことを満たす必要があります。
注︓会員の名前の変更は、ケースバイケースで、インテルの独⾃の裁量に よってのみ許可されます。
会員は、登録の際にパスワードを⼊⼒する必要があり、パスワードとユー ザーネームの機密保持に関する責任を単独で負うものとします。また、会 員は、⾃⾝のアカウントに関するすべての活動に対する責任を負うものと します。そして、会員は、⾃⾝のアカウントの不正使⽤やその他のセキュ リティ侵害の疑いがある場合には、オンライン・ヘルプデスクを通じてイ ンテルに直ちに通知する必要があります。
インテルは、アカウントの不正使⽤の結果発⽣したいかなる損失に対して も責任を負いません。もっとも、会員は、会員のアカウントの不正使⽤に よってインテルまたは他の当事者が被った損失について、責任を負う可能 性があります。
Se um Membro desejar encerrar sua Conta ou remover o conteúdo que enviou, a solicitação deve ser feita entrando em contato com o suporte técnico. Após uma Conta ser desativada, os Membros não poderão participar de nenhum aspecto do Programa. Uma Conta desativada pode ser restabelecida mediante solicitação caso a caso, a critério exclusivo da Intel.

会員は、本規約その他本プログラム上のアクティビティ固有の規約に加 え、常識、職業⼈としての⾏動、および基本的なエチケットに従って⾏動 しなければなりません。また、会員は、州法、地⽅法、連邦法及び国際法 が適⽤される場合は、これらに従わなければなりません。
他のユーザーや会員になりすましたり、虚偽の認証情報を送信することは 詐欺⾏為とみなされ、会員のアカウントは終了するとともに、会員は本プ ログラムから永久に追放される可能性があります。インテルは、詐欺的ま たは違法な活動に従事する個⼈の責任を追及する権利を有します。
会員は、コンテンツのアップロード、チャット、電⼦メール、掲⽰板（以 下に定義します）のいずれが⽤いられたかに拘わらず、投稿されたすべて のコンテンツを含む、本プログラムでのコミュニケーションとアクティビ ティに個⼈的に責任を負うものとします。インテルは、本ウェブサイトに 投稿されたコメントを監視し、独⾃の裁量でコメントを削除する権利を有 します。
本プログラムによって収集されたすべての会員情報は、参加者が申込み時

本プログラムへの参加には、インテルまたはインテルとパートナー企業が 共同で主催する、講師コンテスト、ウェビナー、調査その他の追加の活動 への参加が含まれる場合があります。このような活動には、インテルまた はそのパートナー企業によるテクノロジー・ソリューションのプロモーシ ョンが含まれる場合があります。
インテルは、お客様のプライバシーを尊重することをお約束します。本プ ログラムへの参加を選択することで、登録フォームに含まれる個⼈情報を インテルに提供することができます。お客様の個⼈情報は社内の⽬的に使 ⽤され、オプションを選択した場合には、さらにお客様とのコミュニケー ションに⽤いられることがあります。お客様の情報は、お客様との連絡や お客様へのサービス提供のため最⻑ 2 年間、または法律の要請に従い、保 管されます。インテルのプライバシーに関する⽅針の詳細については、 http://www.intel.com/privacy をご覧ください。
インテルは、お客様のプライバシーを尊重することをお約束します。登録 ⼿続を完了することで、お客様の業務上の連絡先、職種及び個⼈情報をイ ンテルに提供することになります。この情報は、登録⼿続を円滑に⾏い、 快適な体験を提供し、そしてデータ分析のために使⽤されます。インテル は、適⽤されるデータ保護に関する法律および規制、ならびにインテルの プライバシー通知 www.intel.com/privacy に従って個⼈情報を使⽤し ます。.
過去 180 ⽇以内に活動（学習の完了、記事の閲覧、リソースへのアクセ ス、リソースのアップロード）を完了しなかった場合、その会員は休⽌中 とみなされます。当該会員が学習活動を完了するまで、当該会員のアカウ ントは休⽌中となります。
2 年（730 ⽇）経過後、休⽌中のアカウントは消去される場合がありま す。
インテルは、本プログラムのウェブサイト上で 90 ⽇前に通知すること で、本プログラムを終了することができます。インテルは、独⾃の裁量 で、本プログラムの会員条件を含む本規約を修正または変更することがで きます。
本ウェブサイトは、会員がコンテンツ、アイデア及びマテリアル（「会員 コンテンツ」）を公に共有することを⽬的とした活動⼜はサービスを主催 ⼜は企画する場合があります。これらのサービスおよび活動の利⽤は、資 格を有する会員に限定され、本規約およびその他の本プログラム上の活動 固有の規約が適⽤されます。
インテルが、本ウェブサイト上のデータ、テキスト、⾳声、画像、ビデ オ、図、オーディオ、情報、グラフ、記述などの本ウェブサイト上でまた は本ウェブサイトを通じて提出、投稿、送信され、利⽤可能になり、また は表⽰される会員コンテンツに対する所有権を主張することはありませ ん。書⾯で別途合意した場合を除き、会員コンテンツに対する報酬はあり ません。インテルは提出された会員コンテンツを投稿または使⽤する義務 を負わず、インテルは独⾃の裁量でいつでも会員コンテンツを削除するこ とができます。
投稿、アップロード、⼊⼒、提供その他の⽅法で会員コンテンツを提出す ることにより、会員は、インテル、その関連会社、サブライセンシー及び 本ウェブサイトのユーザーに対して、(i) 会員コンテンツおよびそれに含 まれるすべてのデータ、画像、⾳声、テキスト等を（全体的または部分的 に）複製、変更、派⽣物の作成、展⽰、公演、公開、頒布、ライセンス・ サブライセンスの付与、組み込みその他の⽅法で使⽤すること、並びに、 (ii) かかる会員コンテンツをあらゆる商業・⾮商業⽬的で、現在知られて いるまたは将来開発されるあらゆる形式・媒体を⽤いて他の作品に組み込 むことが、全世界で⾮排他的かつ永久的に無償で可能となる、取り消され ることのない、譲渡・サブライセンス可能なライセンスを付与することに なります。
すべての会員コンテンツに関する責任は、公に投稿されたか、私的に送信 されたかにかかわらず、かかるコンテンツの発信元である会員が単独で負 うものとします。すなわち、会員が本プログラムまたは本ウェブサイトを 通じてアップロード、投稿、共有、または表⽰するすべてのコンテンツに 関するすべての責任は、インテルではなく会員が負います。会員は、違 法、脅迫的、中傷的、名誉棄損的、わいせつなもの、その他法律に違反し うるものを投稿または送信することを禁じられています。
会員は、会員コンテンツを投稿または提出することにより、会員が当該会 員コンテンツを提供、投稿、アップロード、⼊⼒または提出するために必 要な権利など、会員コンテンツに対するあらゆる権利を保有または管理し ていることを表明し、保証するものとします。提出された会員コンテンツ に著作権で保護されたコンテンツが含まれる場合、会員は以下のことを表 明し保証するものとします。
(a) 会員が当該コンテンツの著作権者であること、または著作権者が会員 の利⽤⽅法・⽬的に沿った当該コンテンツの利⽤を会員に許諾しているこ と。
(b) 会員が本規約に記載されたライセンスおよびサブライセンスを与える ために必要な権利を有すること。
(c) 当該コンテンツに⼈が描写されている場合は、その⼈がコンテンツの 使⽤に同意していること。インテルは、権利の保有または許諾の証明を要 求する権利を有し、そのような証明がない場合、またはその証明が⼗分で ないとその独⾃の裁量で判断した場合、会員コンテンツの投稿を拒否する ことができる権利を有します。
会員は、インテルが提出された会員コンテンツを管理または事前審査する ことができ、またはこれをしないことができることを認めます。インテル とインテルが指定した者は、インテルの独⾃の裁量に基づき、本ウェブサ イトの会員コンテンツを事前審査、拒否、監視、アクセス制限、編集また は削除する権利を有します。かかる権利を制限することなく、インテル は、侵害的または違法、不適切、本規約を遵守していない、または本ウェ ブサイトの精神や⽬的を満たしていないと独⾃の裁量で判断した会員コン テンツを拒否または削除する権利（ただし義務ではありません）を有しま す。インテルは、独⾃の絶対的な裁量に基づき、会員コンテンツを保存す ることがあり、また、法律または司法もしくは政府の命令によって要求さ れた場合、または本ウェブサイト、ユーザー及び公共の権利、財産及び個 ⼈の安全を守るためにインテルが有⽤であると合理的に判断した場合に は、会員コンテンツを開⽰することもあります。
インテルは本ウェブサイトに投稿された会員コンテンツをコントロールし ていないため、会員コンテンツの正確性、完全性及び品質を保証するもの ではありません。いかなる状況においても、インテルは、会員コンテンツ の誤脱に対する責任や投稿、電⼦メールその他の⽅法で本ウェブサイトを 通じて送信された会員コンテンツの使⽤によって発⽣したいかなる損失や 損害に対する責任を含め、会員コンテンツに対していかなる責任も負いま せん。
コンテンツを提出することにより、会員は、その開⽰が無償で任意に制限 なく⾏われたものであり、インテルに受託者義務やその他の義務を負わせ るものではないこと、インテルが⾃由に当該会員コンテンツ内のアイデア を秘匿しないで誰に対しても開⽰することができ、追加の報酬なしにかか るアイデアを使⽤できることに同意するものとします。会員は、インテル が会員の提出物を受け⼊れることによって、インテルが既に知っていた、 またはその従業員が開発した、あるいは会員以外のソースから取得した類 似または関連するアイデアを使⽤する権利を放棄するものではないことを 認めます。
各会員は、インテルとその関連会社およびそれぞれの代理店、フルフィル メント会社、ベンダー、請負業者、再販業者及び広告・販促代理店・代理 ⼈、並びにそれぞれの役員、取締役、株主、従業員及び代理⼈（総称して 「免責者」といいます）を補償し、あらゆる損失、費⽤、責任、損害及び 請求（合理的な範囲内の弁護⼠費⽤を含みます）（総称して「請求」とい います）から免責することに同意するものとします。「請求」には、商品 若しくは賞品の受領、所有、使⽤若しくは誤使⽤、本プログラム上の活動 への参加、または本プログラム若しくはその⼀部に参加若しくは参加でき ないことにより、全体的または部分的に、直接または間接に⽣じる、死亡 を含む⼈⾝傷害または財産への損傷に対する請求が含まれますが、これら に限定されないものとします。
各会員はさらに、会員が提出、投稿、送信、または本ウェブサイトを通じ て利⽤可能にしたあらゆるコンテンツ、会員による本ウェブサイトの使⽤ その他の本プログラムを通じた⾏為、会員による本ウェブサイトおよび本 プログラムへの接続、会員による本規約の違反、または会員による他の会 員の権利の侵害に起因する第三者からのあらゆる請求について、免責者を 補償し、免責することに同意するものとします。
会員の本プログラムへの参加、本プログラム上の活動及び本ウェブサイト の使⽤は、会員⾃⾝の責任において⾏われるものとします。本プログラム はすべての⾯において、「現状のまま」かつ「利⽤可能な限度で」提供さ れます。本プログラムの商品、賞品、またはその部品に関するすべての保 証は、そのメーカー保証がある場合にはその保証によってのみ提供されま す。本規約に明⽰的に規定されている場合を除き、インテルは、(1) 本プ ログラムまたはそのサービスが会員の要求を満たすこと、(2) 会員による アクセスが中断せず、適時に、安全に、エラーなく⾏われること、(3) 会 員が取得したコンテンツ、製品、サービス、アクティビティ、イベント、 情報、その他の資料の質がその期待に応えるものであること、(4) ソフト ウェアのいかなるエラーも修正されること、(5) 本ウェブサイトにアップ ロードされたいかなるコンテンツも保護され安全であること、を表明し、 保証するものではありません。また、インテルは、（i）本プログラムの終 了、（ii）会員のアカウントの削除、不正アクセス、または変更、（iii）会 員コンテンツ、（iv）本ウェブサイトの使⽤、（v）本ウェブサイト上の第 三者の声明または⾏為を含む本ウェブサイト上のコンテンツ、（vi）本プ ログラム上の活動またはイベントへの参加資格の剥奪、（vii）書⾯、⼝ 頭、黙⽰に⾏われ、または法定されているかどうかにかかわらず、権利侵 害がないことの保証、または取引における取扱・使⽤の過程から⽣じる保 証（商品性または特定の⽬的への適合性に関する保証を含みます）など の、本プログラムに関連し、または本プログラムから⽣じるあらゆる保証 を明⽰的に否認するものとします。
インテルおよびその関連会社並びにそれぞれの役員、取締役、従業員、お よび代理⼈は、いかなる場合も、本プログラム（上記の本プログラムのす べての要素を含みますが、これに限定されません）に起因または関連する 直接損害、間接損害、特別損害、派⽣的損害、または付随的損害（利益の 逸失、評判の喪失、使⽤不可となること、データの損失、事業の中断、お よび代替品の調達費⽤による損害を含みます）について、それがどのよう に⽣じ、保証違反、契約、不法⾏為、過失、無過失責任その他いかなる原 因に基づくかに拘わらず（インテルがそのような損害の可能性について知 らされていたとしても）、会員または会員を通じて請求する者に対して責 任を負わないものとします。
法域によっては、特定の保証の除外、または付随的損害もしくは派⽣的損 害に対する責任の制限もしくは除外が認められない場合があります。従っ て、上記の制限の⼀部は、会員に適⽤されない場合があります。
インテルは、本ウェブサイトの使⽤に関する⼀般的な取扱⽅針や制限を設 けることがあります。インテルはサイトデータをバックアップし、データ の損失や削除が発⽣した場合にそのデータを利⽤できるようにするために 合理的な努⼒をしますが、本ウェブサイトやその他のインテルのサイト上 で他者が維持または送信したデータその他のコンテンツの削除や保存する ことができなかったことに対する責任や義務を負うことはありません。イ ンテルは、⻑期間にわたって活動していないアカウントや会員コンテンツ を削除する権利を有します。インテルは、これらの⼀般的な取扱⽅針をい つでも独⾃の裁量で変更する権利を有します。
インテルのロゴおよびサービスマーク、製品名およびサービス名は、イン テルの商標であり、アメリカ合衆国その他の国における登録商標です（以 下「インテル・コーポレーション・マーク」といいます）。I 本規約は、 インテルの商標またはインテルが所有する資産もしくは知的財産に関する ライセンスを会員に付与するものではありません。その他のすべての名称 およびデザインについては、それぞれの権利者の商標である場合がありま す。

インテルが独⾃の裁量に基づき会員が DMCA に繰り返し違反していると 判断した場合、会員アカウントが無効化され、すべての会員コンテンツが 削除されることがあります。また、インテルはその会員の本プログラムの 会員資格を取り消し、適切な政府機関に通知するなど、必要と思われるそ の他の措置を講じる権利を有します。インテルは、本プログラムのウェブ サイト上で共有されている第三者のコンテンツに対して責任を負いませ ん。
本規約および本規約にリンクが設定されている本ウェブサイト上の情報 は、本プログラムに関する会員とインテルの間の完全な合意を構成し、会 員による本ウェブサイトの使⽤に適⽤されます。各会員は、その会員が本 プログラム上の活動に参加するとき、または関連するサービス、第三者の コンテンツまたはソフトウェアを使⽤するときに適⽤される追加の規約の 対象となる場合があります。本規約のいずれかの条項が管轄裁判所によっ て無効であると判断された場合でも、当事者は、裁判所が当事者の意図が 有効に条項に反映されるよう努めるべきであることに同意し、そして本規 約の他の条項は引き続き完全に効⼒を有するものとします。本規約の条⽂ タイトルは便宜上のものであり、法的または契約上の効⼒はありません。 本規約のうち、アカウントの終了後も存続することが合理的に予想される 条項は、アカウントの終了後も存続するものとし、かかる条項には、会員 アカウント、プライバシーと個⼈情報、会員コンテンツ/掲⽰板、補償と 免責、保証の免責事項、責任の制限、および⼀般条項などが含まれ、これ らは、アカウントの終了、会員による本プログラムのその他の使⽤または 参加の終了にもかかわらず、完全に効⼒を持ち続けるものとします。
本規約および会員とインテルの関係は、抵触法の規定にかかわらずデラウ ェア州法に準拠し、各当事者はデラウエア州内の裁判所の対⼈管轄権およ び専属管轄権に服するものとします。
本規約の違反があった場合、インテルは本規約、法律および衡平法上かか る違反に対して利⽤可能なすべての救済措置を求める権利を有します。本 規約に違反する⾏為は、プログラム・サポートに報告してください（ただ し、著作権侵害に関する申⽴ての⼿順については、3 つ上の項⽬を参照し てください）。
インテルは、この掲⽰を更新することにより、いつでも本規約を改訂する ことができます。本規約は会員を拘束するため、会員は時々このページを 訪れ、最新の本規約を確認する必要があります。本規約の特定の条項は、 本ウェブサイト、特定の活動、または資料上で明⽰的に指定された法的通 知または条項によって置き換えられる場合があります。
